As we gather with our friends and family today to celebrate The Fourth of July, many Americans will notice that something does not feel right in our country. Something is wrong. Something is terribly wrong.

Is our country fundamentally transforming right before our very eyes?

It doesn’t have to.

Our founding mothers and fathers left us with a sacred vision and framework for America’s foundation. These sacred structures are still alive. They continue to live inside each and every concerned American. We are all united by the universal pursuit of Liberty. It may be hard to point out these days, but the natural desire for freedom continues to live within us.

America’s founding mothers and fathers were leaders. So are we. Each and every one of us is a leader. Leadership lives within us just as leadership lived within our founders. Our founders burning desire for a country where man was free to rule himself drove their leadership the same as it drives us today. American Leadership is an inherent, permanent, and inseparable component that lives on today inside of every concerned American.

Even though today’s challenges are causing dismay and turmoil, let’s use this Independence Day to remember that historically America always overcomes our foes through the confidence, the certainty, and the idealism of: New Leadership.

Today we celebrate the birth of America. We celebrate the Declaration of Independence entrusted to us. We celebrate the self-evident truths within the document that are the core of our heritage.

As Leaders, let’s remember these self-evident truths as we fight to restore America.

We are the New American Leadership: Let’s make America feel right again.

US for Palin Publisher Announces SI GOP County Committee Run

With the backing of both American Grizzlies United and the Richmond County Tea Party Patriots I am running to be a GOP County Committee member here on Staten Island. Committee Member is a volunteer elective office that serves a two-year term.

Each Election District can have two Committee Members. Richmond County Tea Party Patriots Core Committee Member Dom D’Arrigo is running alongside me in this district and I gathered signatures for both our candidacies. Since the office is for a political party, the Primary Election is also the General Election. GOP County Committee members meet twice per year, though Tea Party Patriots — backed members, such as D’Arrigo and myself will be meeting once per month. The County Committee ratifies (or not) the candidates chosen by the GOP Executive Committee.

For many years, County Committee members had been merely rubber-stamping the Executive Committee’s candidate choices. This practice is key component to how the Republican Party got saddled with so many RINOs. This will not change until the rubber-stamping stops. As I wrote in my literature,

“I believe our candidates should adhere to these principles:”

  • The Constitution and all its Amendments is the supreme law of the land. The Constitution is absolutely not negotiable.
  • A Republican believes in limited government, low taxes, free markets, strong national defense, and a culture that promotes life and human dignity.
  • The candidate’s principal desire should be to serve We the People.

If elected, I will only ratify candidates who follow the Constitution and adhere to the planks of our party’s platform. I will not go along to get along or bow to peer pressure by rubber-stamping the Executive Committee’s choices.

I will work to build our new first party from the bottom up as President Reagan called on us to do 38 years ago. I will work to ensure that our banner is Bold Colors — no pale pastels — and represents values that we will not compromise, regardless of whether it may be expedient, convenient, or earns the good will of elites in the GOP establishment.

If not now, when?

The Time for Choosing is Now.

Ordinary people can make a difference.

GOP County Committee candidates must gather signatures of 5% of the registered Republicans in the election district. For the 61st Assembly District, 10th Election District in which I am running, 103 voters are registered Republicans. To be safe, I gathered twice the required amount or 10 signatures in four hours over a two-day period.

@AGUGrizzlies: #SCOTUS #Prop8 Ruling Wouldn’t Be Needed If CA #LGBT, #NOH8 Could Read

On Wednesday June 26th the SCOTUS dismissed the notorious Prop 8 case on the basis that the appeal had no standing. This leaves in place the ruling from a San Francisco Judge who struck down the 2008 California ballot measure and completely ignored the votes of the California people.

To complicate matters, it is too early to tell if today’s ruling will only apply to same sex couples who have straightly challenged Prop 8 and the counties where they primitively made the challenges. Or, if by leaving the lower court ruling as is, the San Francisco Judges‘ strike down of Prop 8 will carelessly apply statewide – and same sex marriages will resume.

Time will tell.

(And so will the popular fundraising term: Marriage Equality)

Defense lawyers of Prop 8 declared that they are still faithfully devoted to witnessing the enforcement of Prop 8 in the state:

We’re disappointed about the Supreme Court’s decision on standing, but we are happy that proposition 8 does remain the law in the state of California

The proponents of Proposition 8 and the legal team defending it will continue to defend proposition 8 unless and until there is an appellate court decision from a court with jurisdiction that strikes it down.”

This entire mess could have been avoided (and millions of dollars could have been saved) if the opponents of Prop 8 actually bothered to read the law already on the books in California.

Here at American Grizzlies United we love the 10th Amendment. Our platform The Grizzly Doctrine; A Crib Sheet states:

AGU believes in the traditional definition of marriage. However, we also believe in the right of consenting adults to choose relationships and civil unions that are best for them.

California used the 10th Amendment to give liberty to same sex couples…In 1999!

For the last 14 years in California many same sex couples actually bothered to read the law that is already on the books.

Instead of blindly yelling the popular fundraising term Marriage Equality!, these same sex couples took a minute to read the law already on the books, obtained the necessary paperwork, and filed it.

These informed same sex couples now carry on as law abiding, non protesting, non hoodwinked, non oppressed citizens, who enjoy productive and fulfilling lives.

This was all possible because of our sacred 10th Amendment.

Under California’s Domestic Partnership Registry enacted in 1999 same sex couples:

“…have the same rights, protections, and benefits, and shall be subject to the same responsibilities, obligations, and duties under law, whether they derive from statutes, administrative regulations, court rules, government policies, common law, or any other provisions or sources of law, as are granted to and imposed upon spouses

If you know how to read and write, this liberty is quite simple to obtain. All you have to do is follow the law already on the books.

You don’t even need permission from Charlize Theron, Kathy Griffin, or any other member of the Hollywood Nerd Herd.

Let’s make it really simple for the Hollywood Nerd Herd and the radical Liberal Left:

1) Go to the US Post Office.

2) Fill out the form.

3) Go to any Notary Public and have the form notarized.

4) Mail the form to the California Secretary of State.

5) About a month later the same sex couple (or often times Senior Citizens who find love after their spouse dies but do not want to remarry late in life) will receive a certificate signed by the Governor of California.

California’s Domestic Partner Registry Certificate can be presented to any hospital, any government office, any bank, any place of employment, or any landlord. The certificate will be used to receive the same rights:

“…as are granted to and imposed upon spouses” – 297.5. (a)

It is yet another Liberal and GOPe lie that same sex couples are discriminated against in California.

This is not the opinion of AGU. This is the law of the land in California.

The law is below. You read it, you be the judge.

As you read this law, ask yourself if having the same rights, the same protections, the same benefits, the same responsibilities, the same obligations, and the same duties as married spouses is unequal, second class, homophobic, or Jim Crow.

FAMILY.CODE SECTION 297-297.5

297.  (a) Domestic partners are two adults who have chosen to share
one another's lives in an intimate and committed relationship of
mutual caring.

      (b) A domestic partnership shall be established in California when
both persons file a Declaration of Domestic Partnership with the
Secretary of State pursuant to this division, and, at the time of
filing, all of the following requirements are met:

   (1) Neither person is married to someone else or is a member of
another domestic partnership with someone else that has not been
terminated, dissolved, or adjudged a nullity.

   (2) The two persons are not related by blood in a way that would
prevent them from being married to each other in this state.

   (3) Both persons are at least 18 years of age, except as provided
in Section 297.1.

   (4) Either of the following:

   (A) Both persons are members of the same sex.

   (B) One or both of the persons meet the eligibility criteria under
Title II of the Social Security Act as defined in Section 402(a) of
Title 42 of the United States Code for old-age insurance benefits or
Title XVI of the Social Security Act as defined in Section 1381 of
Title 42 of the United States Code for aged individuals.

Notwithstanding any other provision of this section, persons of
opposite sexes may not constitute a domestic partnership unless one
or both of the persons are over 62 years of age.

   (5) Both persons are capable of consenting to the domestic
partnership.

297.1.  (a) A person under 18 years of age who, together with the
person with whom he or she proposes to establish a domestic
partnership, otherwise meets the requirements for a domestic
partnership other than the requirement of being at least 18 years of
age, is capable of consenting to and establishing a domestic
partnership upon obtaining a court order granting permission to the
underage person or persons to establish a domestic partnership.

   (b) (1) The court order and written consent of the parents of each
person under 18 years of age or of one of the parents or the
guardian of each person under 18 years of age, except as provided in
paragraph (2), shall be filed with the clerk of the court, and a
certified copy of the order shall be filed with the Secretary of
State with the Declaration of Domestic Partnership.

   (2) If it appears to the satisfaction of the court by application
of a person under 18 years of age that the person requires a written
consent to establish a domestic partnership and that the minor has no
parent or guardian, or has no parent or guardian capable of
consenting, the court may make an order consenting to establishing
the domestic partnership. The order shall be filed with the clerk of
the court and a certified copy of the order shall be filed with the
Secretary of State with the Declaration of Domestic Partnership.

297.5.  (a) Registered domestic partners shall have the same rights,
protections, and benefits, and shall be subject to the same
responsibilities, obligations, and duties under law, whether they
derive from statutes, administrative regulations, court rules,
government policies, common law, or any other provisions or sources
of law, as are granted to and imposed upon spouses.

   (b) Former registered domestic partners shall have the same
rights, protections, and benefits, and shall be subject to the same
responsibilities, obligations, and duties under law, whether they
derive from statutes, administrative regulations, court rules,
government policies, common law, or any other provisions or sources
of law, as are granted to and imposed upon former spouses.

   (c) A surviving registered domestic partner, following the death
of the other partner, shall have the same rights, protections, and
benefits, and shall be subject to the same responsibilities,
obligations, and duties under law, whether they derive from statutes,
administrative regulations, court rules, government policies, common
law, or any other provisions or sources of law, as are granted to
and imposed upon a widow or a widower.

   (d) The rights and obligations of registered domestic partners
with respect to a child of either of them shall be the same as those
of spouses. The rights and obligations of former or surviving
registered domestic partners with respect to a child of either of
them shall be the same as those of former or surviving spouses.

   (e) To the extent that provisions of California law adopt, refer
to, or rely upon, provisions of federal law in a way that otherwise
would cause registered domestic partners to be treated differently
than spouses, registered domestic partners shall be treated by
California law as if federal law recognized a domestic partnership in
the same manner as California law.

   (f) Registered domestic partners shall have the same rights
regarding nondiscrimination as those provided to spouses.

   (g) No public agency in this state may discriminate against any
person or couple on the ground that the person is a registered
domestic partner rather than a spouse or that the couple are
registered domestic partners rather than spouses, except that nothing
in this section applies to modify eligibility for long-term care
plans pursuant to Chapter 15 (commencing with Section 21660) of Part
3 of Division 5 of Title 2 of the Government Code.

   (h) This act does not preclude any state or local agency from
exercising its regulatory authority to implement statutes providing
rights to, or imposing responsibilities upon, domestic partners.

   (i) This section does not amend or modify any provision of the
California Constitution or any provision of any statute that was
adopted by initiative.

   (j) Where necessary to implement the rights of registered domestic
partners under this act, gender-specific terms referring to spouses
shall be construed to include domestic partners.

   (k) (1) For purposes of the statutes, administrative regulations,
court rules, government policies, common law, and any other provision
or source of law governing the rights, protections, and benefits,
and the responsibilities, obligations, and duties of registered
domestic partners in this state, as effectuated by this section, with
respect to community property, mutual responsibility for debts to
third parties, the right in particular circumstances of either
partner to seek financial support from the other following the
dissolution of the partnership, and other rights and duties as
between the partners concerning ownership of property, any reference
to the date of a marriage shall be deemed to refer to the date of
registration of a domestic partnership with the state.

   (2) Notwithstanding paragraph (1), for domestic partnerships
registered with the state before January 1, 2005, an agreement
between the domestic partners that the partners intend to be governed
by the requirements set forth in Sections 1600 to 1620, inclusive,
and which complies with those sections, except for the agreement's
effective date, shall be enforceable as provided by Sections 1600 to
1620, inclusive, if that agreement was fully executed and in force as
of June 30, 2005.

@StrongTea1776 Launch Monthly Save the 2nd Rallies

The Richmond County Tea Party Patriots yesterday launched its series of monthly “Save the Second” rallies at the corner of Richmond Ave. and Arthur Kill Road, the same location where the organization rallied to defeat New York Governor Andrew Cuomo and the ill-begotten NYSAFE Act a few short weeks ago.

This was simple hour-long street visibility rally with no formal speakers. Many motorists including the driver of one New York City bus honked in support. As the mercury soared well into the 90s, Bobby Zahn, President of the Tea Party Patriots said, “we all have ‘better’ places to be. I could be in my freaking swimming pool right now. But, you know what? There is no better place to be than here standing up for our freedoms.”

A member of a local gun club spoke about the importance of peacefully protesting and staying engaged in the political process so that the Second Amendment never has to be used for its original intended purpose. Zahn said it was critical to ensure that there is is an “end game” plan for our efforts, to have those honking motorists get engaged and involved rather than forgetting at the next red light.

Tea Party Patriots Core Committee member and American Grizzlies United / Organize4Palin NY State Coordinator, Ron Devito was present at the rally and waved a “Save the Second Amendment” sign written by Virginia Ross.

Richmond County Tea Party Patriots will be holding “Save the Second” rallies on the second of each month at noon if the date falls on a Saturday or Sunday; 1800 / 6 PM if the date falls Monday through Friday. The current location is the northwest corner of Richmond Ave. and Arthur Kill Road, but that is likely to change.

IRS Harasses American Grizzlies United

Tea Party groups nationwide today rallied at IRS offices in protest of the tax agency harassing them and other conservative groups. American Grizzlies United (AGU) has received many inquiries from various groups asking if our political non profit was harassed by the IRS. AGU is currently busy responding to each request as they come in.

American Grizzlies United is a 527 Political Non-Profit, and as such has to file reports about its contributions and expenditures every quarter, as well as a tax return (Form 990) due each May 15. While AGU has not been subjected to ridiculous requests such as turning over website user names and passwords, or being asked “what do you pray about?,” the organization has nevertheless been subjected to IRS harassment.

Form 8872 is used for political organizations such as AGU to report contributions and expenditures. It is filed quarterly and accompanied by receipts documenting each donation received and expenses paid. The filing is similar to what you would see on Federal Election Commission disclosures for PACs and campaigns.

All throughout 2012 the same IRS pattern to claim “missing / late filings” occurred repeatedly.

The big trick is after you submit a required filing they send you a letter saying “our records indicate that Form 8872 has not been filed.”

So, I would file again.

Then a few weeks later I would get the exact same letter saying “our records indicate that Form 8872 has not been filed…”

So I would file again.

This pattern repeated several times.

So I started sending them by certified mail with return receipt.

I have no less than four registered mail receipts which were followed by four letters from the IRS saying “our records indicate that form 8872 has not been filed…”

This occurred during all four quarters of 2012.

Also, to file electronically the log in area and tax exemption log in box area mysteriously disappears from the web browser.

So I call IRS computer support and hold for 45 minutes. Then I am told, “yes something is wrong with the site, it should be fixed soon…”

Richmond County Tea Party Patriots Protest IRS Office

Tea Party groups nationwide today protested IRS harassment of them and other conservative groups. Richmond County Tea Party Patriots was no exception, holding a small protest at high noon outside of Borough Hall which houses a local IRS office. Passersby were mainly supportive of the protest.

In an interview with the Staten Island Advance, “Bobby Zahn, president of the Richmond County Tea Party Patriots, called the IRS actions ‘deplorable, yet expected.’”

“Their attempt to chill the efforts of those they politically disagree with will backfire as groups like the RCTPP will not be intimidated, but rather have their resolve renewed and refocused,” he said.

In a Facebook status, Zahn expressed his disappointment with the Staten Island Tea Party for not being present at the rally. “I have to say I am very disappointed. Normally I try not to go down this road but the SITP should have come out today and joined us at the IRS office at 10 Richmond Terrace. I think it is bad enough that they don’t support our efforts, but this was not our effort. This was a nationwide effort coordinated by Tea parties all over the country,” Zahn wrote.

American Grizzlies United did not have representation at the Patriots’ protest due to full-time work commitments, but issued this statement:

“Across the country today concerned Americans came together to take a stand against the growing mistrust of Big Government. From coast to coast citizens who have had enough of the IRS corruption and misbehavior stood together demanding transparency and basic decency. American Grizzlies United stands with these good citizens who simply want a government that is trustworthy, credible, and sincere.”

As previously reported, the IRS has harassed American Grizzlies United via “forms not filed” or “late filed” notices on timely filed Form 8872 each quarter.

@StrongTea1776, @AGUgrizzlies Rally to defeat NYSAFE Act

Richmond County Tea Party Patriots and Gun Rights Across America yesterday held a rally in the rain to defeat Gov. Cuomo’s unconstitutional and ill-conceived NYSAFE Act. Tea Party Patriots member and American Grizzlies United / Organize4Palin NY State Coordinator, Ron Devito spoke at this rally, beginning at the 21:45 mark in the video. His remarks were covered by the Staten Island Advance.

The Richmond County Tea Party Patriots were initially denied the permit to hold the rally, but it was ultimately granted. The denial may or may not be part of a pattern of harassment and intimidation of Tea Party and conservative groups that has been ongoing with the IRS under the Obama administration and reflecting at the local level.

Transcript of “Molon Labe by Legal, Political Processes”

Fellow citizens and patriots: I would like to begin by asking those of you who served to please raise your hand. We salute you, we honor you, we thank you – without your sacrifice we would not be standing here today.

When we last gathered three months ago on a cold, rainy Saturday, I ended my speech with two Greek words: Molon Labe – Come and Take it. Those words conjure up images of jack-booted thugs kicking down doors to take our guns as we fight in a last stand for freedom.

Back then I discussed some proposed legislation that envisioned confiscation including language in an earlier version of the NYSAFE Act. None of us here ever want to see that day come, so I am here to talk about how we put Molon Labe into action via the legal and political process….

We’ve already taken one of the first steps and that’s by being here today and making our voices heard. Whether we attend rallies and protests; write letters to our elected representatives and newspapers; make phone calls or share calls to action on social media, we must make our voices heard in the ways that work best for each of us. Our representatives need to know: this issue is absolutely not negotiable and if they vote against the Constitution, they’re voting a pink slip for themselves. Period.

When the NRA-ILA seeks funds to help in a lawsuit against NYSAFE, donate. Be sure you join the NRA or if you prefer a smaller group such as Gun Rights Across America, Gun Owners of America, National Association for Gun Owner’s Rights or the Second Amendment Foundation. All these organizations offer easy ways to send letters and make calls to your representatives at the federal and state levels, and you can use these tools for New York State representatives when it comes to NYSAFE.

If someone is charged under the NYSAFE Act, advocate and help his or her legal defense. Those of you who are lawyers can do pro-bono work in this area.

We need to push our representatives for a full repeal of NYSAFE, and keep the pressure up. We need to rally the good politicians by our side and support candidates who will not compromise on this issue.

The left is winning the social media war, and I’m sorry to say it’s because the left is doing social media right. If you’re on Facebook and you see a call to action, a rally notice, or a constructive YouTube, like and share it. Even some of those silly Condescending Wonka posts are worth sharing.

You don’t need to ask for permission and we need to get out of this mentality of asking permission to share. The whole point of Facebook is to share! We don’t post things there for our health or because we like looking at our own stuff. Share, share, and share. Don’t ask. Just do it and get your friends to do the same. On Twitter, if you see an important Tweet, Re-Tweet it. You don’t need to ask to Re-Tweet. Just Do It! The left is doing it right on social media, because they share and they have mastered grassroots organizing.

I also like the Americans for Prosperity model: send an action alert to five people – ask them to execute it and report back to you. You further ask these five people to repeat the process with five of their friends. This mirrors Multi-Level Marketing schemes and it works very well for grassroots political action.

For those of us who do own guns, it is incumbent on us to never become THAT person who is the reason why someone wants to infringe upon or eliminate our rights. Our Second Amendment rights come with grave responsibilities involving life and death.

Some common-sense reminders: if you’re not fit to drive or operate machinery, while you’re in that state you’re not fit to handle guns either. Guns, alcohol, and many medications don’t mix. Raging anger and lingering depression are not a good combination with guns either. We must always adhere to the four cardinal rules of gun safety: a gun is always considered loaded; you never point a gun at anything you’re not willing to shoot; you never put your finger on the trigger until you’re ready to shoot and never shoot unless you are sure of your target and what’s behind it.

While we may disagree with various gun laws, you don’t want to be THAT person who is arrested and made an example of. You are subject to the laws of the jurisdiction you’re in. You don’t want to be THAT person who does something stupid with a gun and you don’t want to ruin your life with a felony charge. You don’t want to be THAT person who gives some politician an excuse to further restrict our freedoms. Being safe, responsible and law abiding with our firearms is not optional – it’s on obligation that comes along with our Second Amendment.

Yes, you do Molon Labe by being safe, responsible and following the law – and working via the legal and political process to repeal bad laws – such as NYSAFE.

Yes, NYSAFE can be consigned to the scrap heap of history, but we must make our voices heard and we must work to make it happen. We cannot wish it away. If we don’t make our voices heard, one day we will see those jack-booted thugs at our doors, and then it will be too late.

Now is the time.
